Official Rules – No Purchase Necessary
TO ENTER: The “American Rag Registration Sweepstakes” (“Sweepstakes”) sponsored by Macy’s (“Sponsor”) begins at 5:01 am Eastern Time (“ET”) on 08/15/08, ends at 11:59 pm ET on 12/15/08, and is open to legal residents of the 50 United States and the District of Columbia. Entrants must be a minimum of 18 years of age at the time of entry, as confirmed by valid government-issued photograph ID. To enter, visit www.AmericanRagCampus.com to register by providing your name, email address, date of birth and affiliated college. There is a limit of only one sweepstakes entry per person or email address. Entries must include a valid e-mail address for entrant. Sponsor reserves the right to disqualify any entrant found to be disrupting the operation of the Sweepstakes or its web site.
PRIZE: (“ARV”) Grand Prizes (3): Macy’s Gift Cards ($500 ARV each); Total value of all prizes: $1500. Any taxes and expenses not mentioned above are the winner’s responsibility. All prizes will be awarded. Odds of winning depend upon the number of entries received.
WINNER:
Three winners will be selected on or about 12/15/08 in a random drawing conducted by Mr. Youth LLC, an independent judging agency whose decisions are final on all aspects of the Sweepstakes. Winners will be notified by e-mail and/or mail and required to complete an Affidavit of Eligibility and Liability/Publicity Release. Affidavit must be returned, executed by the winner without any changes, within fourteen (14) days of the date on the notification or the winner will be disqualified and an alternate winner will be selected. If a prize notification or prize returned as undeliverable, the winner will be ineligible and an alternate winner will be selected. You are not a certified winner until validated and you receive official notification from the judging organization.
GENERAL TERMS: Employees and members of their immediate families (defined as spouses, siblings, parents and children) and households (whether or not related) of Macys, its subsidiaries, affiliated companies, advertising and promotion agencies, electronic media firm, Mr. Youth LLC, and anyone involved in the production, development or handling of this Sweepstakes are not eligible. Void where prohibited by law. Sponsor reserves the right to correct typographical or clerical efforts in any sweepstakes-related materials. No more than the stated number of prizes will be awarded. In the event that production, technical, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims. All federal, state, and local laws and regulations apply. Entrants agree to be bound by these Rules. Prize acceptance constitutes permission (except where prohibited) to use winner’s name and likeness for publicity purposes without additional compensation. Participants, by participating in this Sweepstakes, hereby waive and release, and agree to hold harmless the Sponsor, its subsidiaries, affiliates, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause of thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of a prize in the Sweepstakes, or their participation in the Sweepstakes, or their participation in any Sweepstakes or prize related activity, or any travel related to the Sweepstakes, or any travel for any prize related activity. Sponsor and its agents are not responsible for lost, late, misdirected, damaged, incomplete or illegible entries or Internet technical, hardware, software, telephone, or transmission failures of any kind, which may limit a person’s ability to enter the Sweepstakes. Sponsor and its agents are not responsible for any injury or damage to entrants’ or any other person’s computer related to or resulting from entering or downloading any materials in the Sweepstakes. If for any reason this Sweepstakes is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes, at which time, Sponsor will conduct a random drawing from among all non-suspect eligible entries received at the time of the Sweepstakes termination. In the event of a dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be declared made by the “Authorized Account Holder” of the e-mail address submitted at time of entry. “Authorized Account Holder” is defined as the natural person 18 years of age or older who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Any failure by the Sponsor to enforce any of these Rules shall not constitute a waiver of such Rules.
DISPUTES: By entering the Sweepstakes, entrants agree that (1) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorneys' fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of New York. Any legal proceedings arising out of this Sweepstakes or relating to these rules shall be instituted only in the federal or state courts located in the State of New York, and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these rules. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
USE OF INFORMATION: The information that you provide in connection with the Sweepstakes may be used by Sponsor in accordance with its Privacy Policy, which is found at www1.macys.com/service/start/safeshopping/privacy.jsp and which may be updated from time to time.
